Terms and conditions

General

Yulgo Travels, www.yulgotravels.com (hereinafter “We” or “Us”), all communications and all services related to Yulgo Travels (hereinafter “Services”) are covered by these Terms and Conditions. By using Our Services, you agree to abide by these Terms and Conditions. We reserve the right to modify the Terms and Conditions at any time without notice. By using Our Services, you agree to the modified Terms and Conditions. Please read carefully these conditions to understand your rights and obligations related to Our Terms and Conditions and please communicate with Us if you need more precisions.

Yulgo Travels owns a valid Travel Agency permit from Quebec and Our clients are admissible to claims in the Compensation Fund for Customers of Travel Agents (Fonds d’indemnisation des clients des agents de voyage or FICAV) according to the conditions of the Office de la protection du consommateur.

Jurisdiction

The courts of the province of Quebec (Canada) have the exclusive jurisdiction in regards to all dispute or claim in connection with the use of Our Services, as they are governed by the laws of the province of Quebec (Canada).

Confidentiality, privacy and personal data

You will be required to provide personal informations to use some of Our Services. Please refer to our Privacy Policy to know how We protect your privacy and the confidentiality of your personal data.

Price and Payment Methods

All prices announced on Yulgo Travels website and communications are in Canadian dollars and they include taxes (TPS and TVQ) – unless indicated otherwise. These prices and their availability are updated regularly and can change anytime without notice.

Some expenses are not included in Our trip cost, such as international plane tickets and personal expenses. Please refer to individual tour pages to see the detailed inclusions, exclusions and additional expenses.

We are not responsible for fees charged by your credit/debit cards for the payment processing in a different currency.

We accept those payment methods:

Debit cards;
Checks;
Credit cards: Visa and Mastercard;
Cash

We use a third party payment processor (hereinafter “Payment Processor”) to process your cards and this processing is subject to the terms, conditions and privacy policies of the Payment Processor, as well as these Terms and Conditions. This means that no information related to the transactions you do on Our e-commerce platform, such as your card number, is collected by Us. We are not responsible for the safety of the Payment Processor, so you accept that we can not be held responsible for any problem related to payment transactions between you and the Payment Processor. By doing a transaction, you are responsible to verify it has been processed properly. We keep the right to correct any mistake, even if the payment has already been received.

Booking

The full amount is required to reserve your spot. Your reservation is official when We send you a confirmation email mentioning it. We keep the right to modify the price of the trip before the trip is confirmed or to refuse any reservation at Our own discretion. Please note that the trips take place only if there is a minimum of participants and if it is not the case, We will refund your entire payment.

Trip Cancellation and Refund

Please contact us at info@yulgotravels.com for any trip cancellation request. Each trip has its own cancellation policy, so please refer to the tour’s page for more information.

Travel Documents and Insurance

It is your sole responsibility to ensure that you meet the criterias to enter and exit the destination. You are responsible for verifying the validity of your passport, visa and other travel document. Generally, your passport must be valid for a minimum of 6 months following the departure date from the visited country. You have the sole responsibility to pay any fine, penalty or expenditure incurred as a result of such documents not meeting the requirements of immigration.

In each tour’s description, We inform you about the entry and exit requirements of each destination. However, these informations are for reference only and We are not responsible for any mistake. It is your sole responsibility to verify with your governmental authorities for precise informations.

It is mandatory to have a valid travel insurance for the length of the trip to participate. Your insurance needs to include a medical insurance.

Health

It is your sole responsibility to ensure you are in good health when participating to Our trips. If you have a physical or mental condition that could affect your participation in Our trips, please inform Us when booking. If your health condition changes after your reservation, please inform Us before the first day of the trip. We are not responsible for providing facilities and care adapted to your condition. We do not guarantee any care you would receive in a medical facility at destination. It is your sole responsibility to get a travel insurance including a medical insurance. This insurance is mandatory to participate in Our trips. However, we will try Our best to help you if medical care is needed, but We will not be responsible for the quality of this care.

You have the sole responsibility to make sure you have all the required vaccination and medication for the trip. We recommend that you consult a doctor to make sure you meet the health-related requirements for your trip.

Photography

We could take photos and videos of you on one of Our trips and by participating to Our trips, you agree that We use it for any of Our Services. However, We will not use them if you specifically request not to use any image you are depicted in. By agreeing to those Terms and Conditions, you grant Us a royalty-free, worldwide and irrevocable license to use them to promote Our Services.

E-commerce platform

We try to maintain accurate information regarding Our Services availability, but we can not guarantee any such accuracy. We reserve the right to cancel or refuse any order, even if it was confirmed, in the event of an incorrect price, due to typo error for example. We will issue a credit to your credit card account if it has been charged.

Links to other sites

Some of Our Services contain links to external websites. However, the presence of these links does not guarantee Our adherence to their content and We are not responsible for their content, products, services and links. Please refer to their Privacy Policy and to their Terms and Conditions before using their services. Any complaint or claim regarding their services must be addressed to them.

Use of Our Services

By using Our Services, you agree not to disturb them. This implies that you shall not submit content that involves any illegal or immoral activities, nor activities that are contrary to public order. Obscene, vicious and coarse language is also prohibited and We reserve the right to remove this content from Our Services. You are solely responsible for the content you submit by using Our Services.

Intellectual Property Rights, Copyrights and Trademarks

All the content of Our Services, including but not limited to Our names, logos, domain names, designs and other content are protected by the laws applicable to intellectual property, copyright, trademarks, patents and by any other rights set in existing legislation. It is strictly forbidden to use in any possible way Our content, unless We give you authorization to use it. You agree that any unauthorized use could be subject to prosecution.

By accepting Our Terms and Conditions, you grant Us a royalty-free, worldwide, non-exclusive, sublicensable and transferable right to reproduce or use any content you make available on Our Services, including the right to use this content to promote Our Services. You acknowledge and guarantee that this use does not violate the rights of any other third party.

Warranty

We make no warranty, including but not limited to warranties of quality, integrity and safety of Our Services. We do not guarantee that Our Services will reach your expectations and will be 100% accurate. We do not guarantee an uninterrupted and safe access to Our Services. We do not guarantee that Our Services are free of any virus or harmful components. All the content of Our Services could include mistakes, including but not limited to availability, price, photo descriptions, inclusions and exclusions of Our trips. We keep the right to modify and update any mistake regarding Our Services including unconfirmed reservations published at the wrong price.

By agreeing to these Terms and Conditions, you accept to be the sole responsible for any damage sustained when downloading material from Our Services.

Liability

We can not under any circumstance be held responsible for any direct or indirect damage, including but not limited to accidents, injuries, delays, loss of personal belongings and loss of enjoyment.

You accept that We can modify, remove, suspend, cancel and stop Our Services (or part of them) for an undetermined time, anytime, without notice.

Every third party collaborating with Us is independent and offers services separate from Ours. We are not responsible for any damage, including but not limited to mistakes, omission, accident, injury, delay and cancellation caused by this third party.

By accepting these Terms and Conditions, you understand and accept that your participation to one of Our Trips includes elements of personal risk. We can not be held responsible and will not assume any risk from your actions and conduct while using Our Services or for the loss or theft of personal objects.
